Terms of Service

These Terms govern your use of newmail.click (the "Service"), operated by KAVELA LTD (company number 17051996, registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom). By using the Service you agree to these Terms.

1. The Service

newmail.click lets you generate HTML email signatures and, on the Pro plan, track clicks and opens on links and pixels embedded in those signatures.

2. Accounts

You sign in with a Google account. You are responsible for keeping that account secure and for all activity under your newmail.click account. You must be at least 16 years old to use the Service.

3. Acceptable use

You agree not to:

• Use the Service to send spam or unsolicited bulk email.
• Track recipients in violation of applicable law (including GDPR, PECR or CAN-SPAM).
• Embed tracking links in messages that impersonate another person or organisation.
• Distribute malware, phishing pages, or content that infringes third-party rights.
• Attempt to interfere with, reverse-engineer or overload the Service.

4. Your content

You retain ownership of the content you put into your signatures. You grant us a limited licence to store, process and display that content as needed to operate the Service.

5. Paid plans

The Pro plan is billed monthly ($19/month) or annually ($149/year) through Stripe, with a 7-day free trial. Fees are charged in advance after the trial ends and are non-refundable except as described in our Refund Policy. We may change pricing on 30 days' notice; changes will not affect the current billing period.

6. Cancellation

You can cancel your Pro subscription at any time from the dashboard. Cancellation takes effect at the end of the current billing period; your Pro features remain active until then.

7. Termination

We may suspend or terminate accounts that violate these Terms or that pose a security or legal risk to the Service or its users. Where possible we will give notice and an opportunity to remedy the issue.

8. Service availability

The Service is provided "as is". We do not guarantee uninterrupted availability and we may modify or discontinue features at any time. We will make reasonable efforts to notify Pro subscribers of material changes in advance.

9. Liability

To the maximum extent permitted by law, our total liability for any claim arising out of the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental or consequential losses, including lost profits or lost data.

10. Indemnity

You agree to indemnify us against any third-party claim arising from your misuse of the Service or breach of these Terms.

11. Governing law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer-protection law in your country says otherwise.

12. Changes

We may update these Terms. Material changes will be notified by email or in-app notice at least 14 days before they take effect.
